Supreme Court Upholds Invalidation of ABL-held Informatics Patents

NEW YORK (GenomeWeb) – Last week, SmartGene said that the United States Supreme Court has denied an attempt by Advanced Biological Laboratories to vacate a favorable ruling from the US Court of Appeals for the Federal Circuit related to two ABL patents that have been the subject of a seven-year lawsuit between both companies.

The ABL patents in question — both of which cover computerized methods for selecting treatment regimens for patients with known diseases — were initially invalidated by the US District Court for the District of Columbia. ABL appealed the decision but in February this year the US Court of Appeals upheld the district court's ruling. ABL then petitioned the Supreme Court which has now denied its claim.
